Architect Zaini Othman, 59, was fined RM2,000 for throwing his shoe at a stray cat at his condominium lobby at Taman Tun Dr. Ismail, Kuala Lumpur.
He was charged under Section 44(1)(a) Animal Act 1953 and can be penalised according to Section 44(1) of the same act with a maximum fine of RM50,000 of serve jail time up to one year, or both.
During the hearing, Zaini, who did not have a lawyer present, told the court that he was not aware that his actions were wrong and begged to be spared from going to prison as he wished to celebrate Hari Raya Aidilfitri next week.
The father of 3 also claimed that he does not have a fixed salary and requested that his shoe, used as evidence by the Veterinary Services Department, be returned to him.
Kuala Lumpur Veterinary Services Department Prosecutor, Mohd Sharif Sabran asked that a heavier sentence be imposed, taking into account that the man did such actions to a cat that does not have the ability to speak, and does not have an owner.
The report was made by a resident at the condominium. According to the CCTV recording, the cat was visibly terrified and tried to run away from Zaini who chased him and throwed his shoes a few times at the direction of the cat.
